1. Introduction
These Terms & Conditions ("Terms") govern the use of the TesseraMia service by end users (“Cardholders”).
TesseraMia is a digital platform that enables businesses to issue membership cards, loyalty cards, event passes, and digital IDs compatible with Apple Wallet and Google Wallet.
By using a digital card issued through TesseraMia, you agree to these Terms.
2. Service Description
TesseraMia allows users to:
- Receive digital membership or loyalty cards
- Store cards in Apple Wallet or Google Wallet
- Accumulate loyalty points (where applicable)
- Redeem rewards offered by the issuing business
- Receive updates and notifications related to the card
TesseraMia does not directly control the rewards or programs offered by businesses (Tenants).
3. User Relationship
The contractual relationship regarding the card, points, and rewards exists between the Cardholder and the issuing business (Tenant).
TesseraMia acts as a technical platform provider.
4. Eligibility
Users under 16 years of age may only use the Service with parental or legal guardian authorization.
By using the Service, you confirm that you meet this requirement.
5. User Data
Depending on the issuing business, we may process:
- Full name
- Email address
- Date of birth
- Phone number (optional)
- Loyalty points data
- Transaction or redemption history
- Digital card identifiers
6. Loyalty Points and Rewards
Depending on the issuing business:
- Loyalty points may be earned through purchases or actions defined by the Tenant
- Points may be redeemed for discounts or gifts
- Points have no cash value unless explicitly stated by the Tenant
- TesseraMia is not responsible for the value, availability, or validity of rewards
7. Notifications
Users may receive notifications related to:
- Loyalty updates
- Card updates
- Promotional offers from the issuing business
Notifications may be sent via:
- Push notifications
Notification frequency may be limited to prevent abuse.
8. Wallet Integration
Cards may be added to:
- Apple Wallet
- Google Wallet
These services are operated by Apple and Google, and their use is subject to their own terms and privacy policies.
9. Account Suspension and Termination
TesseraMia or the issuing business may suspend or deactivate cards or accounts in cases of:
- Fraudulent activity
- Abuse of the system
- Violation of these Terms
- Spam or misuse of notifications
10. Data Retention
User data may be retained for up to 30 days after account or card deletion.
After this period, data is permanently deleted unless required by law.
11. Limitation of Liability
To the maximum extent permitted by law:
- TesseraMia is not responsible for the actions of issuing businesses
- TesseraMia does not guarantee the value of rewards or loyalty programs
- TesseraMia is not liable for indirect or consequential damages
12. Service Availability
We strive to maintain continuous service but do not guarantee uninterrupted access.
Maintenance, updates, or technical issues may temporarily affect availability.
13. Changes to Terms
These Terms may be updated at any time.
Continued use of the Service constitutes acceptance of the updated Terms.
14. Governing Law
These Terms are governed by Italian law.
Any disputes shall fall under the jurisdiction of the competent courts of Italy (Province of Pesaro e Urbino).

Terms for Business Customers

1. Introduction
These Terms & Conditions (“Agreement”) govern the use of the TesseraMia platform by business customers, organizations, associations, and any entity (“Tenant”) issuing digital cards through the Service.
TesseraMia is a SaaS platform that enables the creation, management, and distribution of digital membership cards, loyalty cards, event passes, and digital IDs compatible with Apple Wallet and Google Wallet.
By creating an account or using the Service, the Tenant agrees to be bound by this Agreement.
2. Service Description
TesseraMia provides a platform that allows Tenants to:
- Create and manage digital cards
- Manage members and cardholders
- Assign and manage loyalty points
- Define rewards and redemption rules
- Send limited notifications to cardholders
- Monitor basic usage of the Service
TesseraMia acts strictly as a technology provider and does not control the commercial relationship between Tenants and their customers.
3. Account Registration
To use the Service, Tenants must:
- Provide accurate and complete information
- Maintain the confidentiality of login credentials
- Ensure that authorized personnel manage the account
TesseraMia reserves the right to suspend accounts with false or incomplete information.
4. Eligibility
The Tenant represents that it is legally authorized to operate and use the Service under applicable laws.
5. Fees and Payments
The Service is offered on a subscription basis.
Tenants agree to pay applicable fees monthly or annually as selected.
Payments are processed via third-party providers (e.g., Stripe).
TesseraMia does not store full payment card details.
Failure to pay may result in suspension or termination of the Service.
6. Loyalty System
Tenants may:
- Create loyalty programs
- Assign points to users
- Allow redemption of points for discounts or gifts
Important:
- Loyalty points have no monetary value unless explicitly defined by the Tenant
- TesseraMia is not responsible for the value or redemption of rewards
- Tenants are solely responsible for the accuracy of their loyalty programs
7. Notifications
Tenants may send limited notifications to their cardholders.
Allowed types:
- Service updates
- Loyalty updates
- Marketing notifications (limited usage)
Tenants must not:
- Send spam
- Exceed reasonable notification limits
- Misuse the notification system
TesseraMia may impose limits or suspend notification access in case of abuse.
8. Prohibited Use
Tenants agree not to use the Service to:
- Engage in illegal activities
- Send unsolicited or abusive communications
- Misrepresent identity or services
- Violate applicable EU or Italian laws
- Upload harmful, fraudulent, or misleading content
9. Suspension and Termination
TesseraMia may suspend or terminate Tenant accounts if:
- Terms are violated
- Fraud or abuse is detected
- Spam or system misuse occurs
- Payment obligations are not met
Tenants may cancel their subscription at any time.
10. Data Protection
Tenants act as Data Controllers for their end users.
TesseraMia acts as a Data Processor under GDPR.
Tenants are responsible for:
- Lawful collection of end-user data
- Providing appropriate legal basis for processing
- Ensuring transparency with their customers
A Data Processing Agreement (DPA) is available upon request.
11. Data Retention
Upon account deletion or termination:
- Data is retained for up to 30 days
- After this period, data is permanently deleted unless required by law
12. Intellectual Property
All rights related to the TesseraMia platform remain the property of the service owner.
Tenants retain ownership of their brand, logos, and content uploaded to the platform.
13. Liability
To the maximum extent permitted by law:
- TesseraMia is not responsible for Tenant-customer relationships
- TesseraMia does not guarantee business performance or customer engagement
- TesseraMia is not liable for indirect or consequential damages
14. Service Availability
The Service is provided on an “as is” and “as available” basis.
We do not guarantee uninterrupted or error-free operation.
15. Modifications
TesseraMia may update these Terms at any time.
Continued use of the Service constitutes acceptance of updated Terms.
16. Governing Law
This Agreement is governed by Italian law.
Any disputes shall be subject to the jurisdiction of the courts of Italy, Province of Pesaro e Urbino.
